TERMS OF SERVICE
ChiCa Terms of Service
Welcome to ChiCa. These Terms of Service form an agreement between you and 厦门湖里区沏咖软件开发工作室 (Xiamen Huli District ChiCa Software Development Studio) concerning registration, sign-in, and use of ChiCa services. Please also read the ChiCa Privacy Policy before using the services.
Please read and understand these Terms of Service and the ChiCa Privacy Policy before using the services. By registering, signing in, or actually using the services, you agree to be bound by these terms. If you do not agree, stop registering, signing in, or using the services.
1. The Services
ChiCa is a hand-brewed coffee recording and assistance tool. Depending on the app version and the page shown to you, it may provide bean management, brewing recipes, brew timers, parameter correction, history, bean intake by photo, AI reviews, accounts, and authentication. The features available to you are determined by the version of the app and the service display.
Signed-in users can use offline-first synchronization to recover beans and completed brew records, together with necessary child resources and valid review results stored with those records. In-progress brew drafts, equipment libraries, custom recipes, app preferences, and original bean-intake photos are not part of the initial ordinary cloud-synchronization scope. Cloud brew history is normally retained on a rolling basis for the most recent 365 days for free or trial accounts; professional-member and administrator accounts are not automatically cleaned by record age while the account remains valid. The detailed processing rules are in the Privacy Policy.
Some features may be experimental and may involve changes, interruptions, inaccurate results, or data-format changes. We will make reasonable efforts to maintain a stable service, but do not promise that the service will remain unchanged or error-free.
2. Account Registration and Security
- You may register and sign in with Apple, by phone verification, or through another method offered during testing.
- You must provide information that is truthful, lawful, and valid, and protect your device, account, and sign-in credentials.
- You are responsible as permitted by law for risks caused by voluntarily disclosing credentials, sharing an account, or failing to protect your device.
- Contact us promptly if you discover unusual account activity, credential disclosure, or another security problem.
- To protect the service and other users, we may lawfully verify identity, limit requests, suspend high-risk operations, or revoke unusual sessions.
3. Acceptable Use
You may not use the services to:
- violate laws, regulations, public order, or another person's lawful rights;
- create accounts in bulk, maliciously trigger SMS messages, bypass verification, attack interfaces, or interfere with service operations;
- upload unlawful content, malicious code, personal information that you have no right to process, trade secrets, or other protected content;
- copy, modify, reverse engineer, rent, sell, or otherwise commercialize the services without permission;
- impersonate another person or use AI-generated content in a fraudulent or misleading way; or
- engage in another activity that may harm us, users, providers, or the public's lawful rights and interests.
If you violate these rules, we may, depending on the risk, warn you, restrict features, suspend or terminate the account, preserve necessary evidence, and report to authorities where required by law.
4. User Content and Data
You retain the rights you have under applicable law in the coffee records, text, and photos that you enter or upload, and you promise that you have the right to provide them to the services. You authorize us to process that content only as necessary to provide, maintain, and improve the features you actively use.
Coffee records, drafts, equipment, and preferences normally remain on your device. When you use ordinary cloud synchronization, AI reviews, bean intake by photo, or another cloud feature, the necessary snapshot or file may be uploaded to our servers or a third-party service. Ordinary synchronization and AI reviews are separate paths; signing in does not automatically upload active drafts, equipment libraries, custom recipes, app preferences, or original photos outside the synchronization scope. See the ChiCa Privacy Policy for the processing rules.
You should keep your own copies of important data. Device damage, system cleanup, app deletion, account switching, or an upgrade of a test build may affect data stored only locally. After an account-deletion request is accepted, cloud data is handled under the account-deletion rules in the Privacy Policy.
5. AI and Brewing Suggestions
- AI-generated content is based on the information you provide and the model's capabilities. It may be incomplete, inaccurate, or unsuitable for your equipment, beans, or conditions.
- AI suggestions are for coffee-brewing experiments only and are not medical, health, food-safety, or other professional advice.
- You must independently decide whether to follow a suggestion by considering the coffee's condition, equipment instructions, dietary restrictions, and your own physical condition.
- Do not enter identity-document details, financial-account information, precise addresses, another person's private information, or other sensitive information unrelated to coffee brewing into an AI feature.
6. Intellectual Property
ChiCa's trademarks, name, logo, interface design, software, documentation, default content, and other legally protected works belong to us or the applicable rights holders. Without permission, you may not copy, distribute, modify, or use them commercially beyond ordinary personal use.
Using the services does not transfer ownership of user content that you own under applicable law. To store, recognize, analyze, and display content at your request, you grant us a necessary, non-exclusive, revocable, service-purpose-limited license to process that content.
7. Third-Party Services
The services may use Sign in with Apple, Alibaba Cloud CAPTCHA 2.0, SMS Authentication, object storage, and AI models. Third-party services may be subject to their own terms and policies. We select providers with reasonable care and require lawful data protection, but a third party's network failure, policy change, or uncontrollable interruption may affect some features. The Privacy Policy describes the personal information processed by third parties.
8. Changes, Interruptions, and Termination
To improve the product, meet legal requirements, respond to security risks, or address third-party changes, we may modify, suspend, or terminate part of the services and will provide notice through the app or website when reasonably practicable. Emergency security measures, force majeure, or actions that must be taken immediately by law are exceptions.
You may stop using the services, sign out, or request account deletion. Deleting an account is not the same as deleting the app; the Privacy Policy governs account and personal-information deletion.
9. Limits of Responsibility
We will make reasonable efforts required by law to maintain a secure and reliable service. To the extent allowed by law, we are responsible only as required for effects caused by matters outside our reasonable control, including force majeure, basic communications failures, third-party service interruptions, device or system failures, and improper user operation.
Nothing in this section excludes or limits consumer rights or liability that cannot be excluded or limited under applicable law.
10. Changes to These Terms
We may update these terms because of feature, operational, or legal changes. Updated terms will be published on the website or in the app. If a change materially affects your rights, we will provide a prominent notice. Where new consent is required by law, we will obtain it before providing the affected service.
11. Governing Law and Disputes
The formation, performance, and interpretation of these terms are governed by the laws of mainland China. For a dispute arising from these terms or the services, the parties should first try to resolve it through friendly consultation. If consultation fails, either party may bring an action before a competent court as permitted by law.
